DMCA & Copyright Policy

1. Our Position

Nuvira LLC respects the intellectual property of others and expects the people who use PikLuv to do the same. We respond to notices of claimed copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and with other applicable intellectual property laws.

The pictures and conversations on PikLuv are generated by artificial intelligence. Users cannot publish content to other users, and the only file a user can upload is a private account profile picture. If you nevertheless believe that anything on PikLuv copies your copyrighted work, tell us using the process below.

2. How to Send a Takedown Notice

Send a written notice to our copyright agent (section 5) that includes all of the following:

• Your physical or electronic signature, or that of a person authorised to act for the copyright owner.
• Identification of the copyrighted work you say has been infringed, or a representative list if there are several.
• Identification of the material you say is infringing, with enough detail for us to find it: the page address, the companion's name, and the date if you know it.
• Your name, postal address, telephone number and email address.
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act for the owner.

A notice that leaves out any of these may not be valid under the DMCA, and we may ask you to complete it before we act.

3. What We Do With a Valid Notice

• We remove or disable access to the material promptly.
• Where the material is tied to a user account, we tell that user and give them a copy of the notice.
• We keep a record of the notice and of what we did.
• We terminate the accounts of users who infringe repeatedly.

We aim to acknowledge a notice within 24 to 48 hours and to act on it within five business days, in line with our Complaints, Content Removal & Appeals Policy.

4. Counter-Notice

If material connected to your account was removed and you believe that was a mistake or a misidentification, you may send our copyright agent a counter-notice that includes:

• Your physical or electronic signature.
• Identification of the material that was removed and where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
• Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Nuvira LLC may be found), and that you will accept service of process from the person who sent the original notice.

We send a valid counter-notice to the person who filed the original notice. Unless that person tells us within 10 business days that they have filed a court action, we may restore the material.

6. False Notices

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you are not sure whether something infringes your copyright, consider speaking to a lawyer before you send a notice.

7. Our Own Content

The PikLuv name, logo, companions, artwork, text and software belong to Nuvira LLC and are protected by copyright and other laws. See section 9 of our Terms and Conditions. Pictures generated for you are for your personal, private use.
